Pakai Software Bajakan, 11 Perusahaan di Serpong Digulung

Jakarta - Penegakkan hukum terkait penggunaan software ilegal kembali
menyeruak. Kali ini, Polsek Serpong menggulung 11 perusahaan sekaligus
menyita sejumlah komputer yang terdapat software bajakan tersebut.

Donny A. Sheyoputra, perwakilan Business Software Alliance (BSA) di
Indonesia mengatakan, penindakan terhadap kesebelas perusahaan yang
berdomisili di sekitar Serpong tersebut dilakukan dalam rentang bulan
Juli sampai Desember 2007.

Pelaku yang ditindak pun berasal dari berbagai sektor. "Yang saya tahu
ada yang bergerak di bidang percetakan, bank, lembaga pembiayaan atau
finance hingga perusahaan pembuat beton cor," ujar Donny ketika
berbincang dengan detikINET, Rabu (20/2/2008).

Software besutan Microsoft, Windows dan Microsoft Office, masih menjadi
software primadona bagi para pelaku. Terbukti, kedua software tersebut
paling banyak ditemukan di dalam komputer pelaku, selain antivirus
Norton buatan Symantec dan Adobe Photoshop.

Donny menambahkan, tiga kasus sudah diajukan ke pengadilan (P21)
sementara sisanya baru Surat Pemberitahuan Dimulainya Penyidikan (SPDP).
Pelaku selanjutnya bakal dijerat Pasal 72 ayat 3 UU Hak Cipta dengan
ancaman kurungan 5 tahun dan atau denda Rp 500 juta.

BSA adalah asosiasi yang menaungi berbagai perusahaan piranti lunak.
Dalam kasus sweeping ini, BSA ditunjuk oleh Polsek Serpong sebagai saksi
ahli.

"Jadi jika mereka (polisi) mau gerebek, mereka jalan duluan sampai
panggil tersangka dan sebagainya. Nah setelah itu, baru biasanya BSA
dipanggil sebagai saksi ahli, sekaligus mengkonfirmasi (produk) ini
anggota BSA bukan," tandas Donny. ( ash / wsh )

I am concerned by the possible use of software patents to patent business methods, education methods, health methods, etc.

I am concerned by the current track record of abuses from the European Patent Office, especially by their tendency to abuse their judicial power to extend the scope of patentability.

I am surprised that no economic report has ever been published by European Authorities to study the impact of software patents on innovation and competition.

I urge decisionmakers at all levels in Europe to enforce the Law, which clearly prohibits patenting pure computer programs, instead of changing it.

I urge decisionmakers at all levels in Europe to reconsider their current plans and to make sure patents are not abused to prohibit or restrict the dissemination of computer programs and intellectual methods.
